MrFixer Guarantee

MrFixer is New Zealand’s premier; Plumbing, Gas, Electrical, Painting, Plastering, Tiling and Handyman Franchise. Each MrFixer sub-franchisee are owners of their own businesses, are qualified experts in their field of trade services, and they can fully guarantee their workmanship.

Each sub-franchisee owner of MrFixer has an obligation to provide to the customer the ‘MrFixer On-Time Guarantee’. The on-time guarantee is based on the MrFixer sub-franchisee agreeing a time frame with the customer of when they will be on site to undertake the service they are providing. If they do not turn up within that timeframe then they will provide the first 1/4 of labour of the completed job to the customer at no cost.

The only exception to the ‘MrFixer On-Time Guarantee’ would be based on force majeure where the MrFixer sub-franchisee is not liable for any failure or other thing that is not reasonably foreseeable or that is outside their reasonable control (such as an earthquake, flood, road outage etc). MrFixer Group Ltd is not in anyway  liable for any breech of its sub-franchisee’s failure to meet the On-Time guarantee.

The workmanship of MrFixer sub-franchisees is guaranteed by each individual sub-franchisee – if you have any queries or require clarification regarding this please discuss directly with the sub-franchisee you are working with.

Our liability: You use at your own risk. We will never in any circumstances be liable to you or any other person in contract, tort, negligence, equity or in any other way for any loss or damage of any kind, arising from or in relation to your use of, or inability to use, or a MrFixer sub-franchisee.

All services and rates will be negotiated and provided by MrFixer sub-franchisees. MrFixer Group Limited (the franchisor or the MrFixer system) accepts no liability whatsoever in respect of the services or charges provided between the sub-franchisees and the customer.

MrFixer sub-franchisees are expected to be courteous to customers and will take all reasonable care when providing services to you. However, except to the extent required by law, MrFixer Group Limited will not be liable to you (and nor will any of the MrFixer sub-franchisees) for any loss, damage or expense you may suffer or incur in connection with the provision of services provided to you by the sub-franchisees howsoever arising and in any case, the liability of MrFixer Group Limited and its sub-franchisees will be limited to the actual direct damages suffered by you as a result of any gross negligence, wilful default or fraudulent act on our/their part and will under no circumstances exceed the price of the services actually paid by you to MrFixer Group Limited or its MrFixer sub-franchisees.

Where you are not deemed as a ‘Consumer’ (as defined under the Consumer Guarantees Act 1993) or where you are acquiring goods for the purpose of a business then:

(a) the only warranties, guarantees or undertakings we give you in relation to the goods (whether in relation to qualify, fitness for purpose or otherwise) are those which a MrFixer sub-franchisee expressly stipulate to you in writing;

(b) the provisions of the Consumer Guarantees Act 1993 shall not apply.

If however, you are not purchasing goods for the purpose of a business, and you are a Consumer, then notwithstanding anything contained in these Terms and Conditions you shall have the rights as outlined under the Consumers by the Consumer Guarantees Act.
